Picking the Right Family Solicitor: What to Check First

What separates a good family solicitor from a merely local one

Most people looking for a family solicitor start with a map. A search for child law solicitors near me will return a dozen firms within five miles, and almost none of them will tell you on the homepage whether they actually do children work week in, week out, or whether they take the occasional case between conveyancing files. The distinction matters more in family law than in almost any other area, because the outcome usually turns on negotiation and courtroom judgement rather than paperwork.

Two marks are worth looking for before you pick up the phone. The first is membership of Resolution, the association of family lawyers that asks its members to commit to a code of practice centred on reducing conflict and putting children first. Resolution family lawyers are not automatically better advocates, but the code does signal a particular approach to correspondence and settlement, which is what most cases actually need. The second is Law Society accreditation in a relevant specialism, such as children law or family law. The quality solicitors law society scheme, as it is usually described in conversation, requires a portfolio, assessments and periodic re-accreditation, so it is a reasonable proxy for genuine expertise rather than marketing confidence.

Neither badge guarantees a good fit. Ask directly how many children cases the solicitor has handled in the last year, whether they have rights of audience to appear in the higher courts, and how often they instruct a barrister. A solicitor who does their own advocacy keeps your costs down and knows the detail of your case better than a handover to counsel does.

Fees: what a family solicitor actually costs in 2024 and 2025

Hourly rates outside London typically run from about £150 to £250 plus VAT for a solicitor, and £250 to £400 for a partner. London and the larger regional firms sit considerably higher, and Legal 500–listed practices in Manchester, Leeds or Birmingham can be £300 an hour before VAT for senior staff. A straightforward divorce on an undefended basis, dealing only with the financial consent order, might come in at £1,200 to £2,500. A contested children matter that reaches a finding of fact hearing will cost many multiples of that.

Fixed fees are increasingly common for defined tasks: a consent order, a prenuptial agreement, an initial advice session. Ask for a written estimate of costs at the outset and an update if the estimate is likely to be exceeded — this is a regulatory requirement under the SRA Transparency Rules. If a firm will not commit anything to paper, treat that as a warning.

Legal aid for family matters is now largely confined to cases involving domestic abuse, child protection proceedings and forced marriage. Eligibility is means-tested and strict. If you are just above the threshold, ask whether the firm offers unbundled or limited-scope advice — paying for drafting and a single negotiation session rather than full representation can cut a bill by more than half.

Mediation first, court second

Since the Family Procedure Rules changed in April 2024, the court expects parties to have attempted non-court dispute resolution unless there is a genuine reason not to. Most solicitors will now signpost a FMC-registered mediator before issuing an application, and a MIAM meeting is normally required for children and financial cases. Mediation sessions with a family mediator typically cost £100 to £200 per person per hour, which compares well with two solicitors exchanging letters at £200 an hour each.

This does not mean mediation suits every situation. Where there is coercive control, an imbalance of bargaining power, or an urgent need to protect assets, advice and court action should come first. A good solicitor will explain which side of that line your case falls on rather than defaulting to either position.

A practical checklist for the first meeting

Book an initial consultation — many firms offer a free 30-minute session or a fixed-fee meeting of around £100 — and take a chronology of key dates, a summary of household finances, and any existing court orders or correspondence. Ask what the solicitor thinks the likely range of outcomes is, what the timetable looks like, and what the single biggest cost risk is. If the answer is vague on all three, try another firm.

Check regulation as well as reputation. Solicitors in England and Wales should appear on the Solicitors Regulation Authority register; check the firm's practising address and whether it holds a legal disciplinary practice licence. Firms with several offices, such as those covering towns like Stamford in Lincolnshire or Southport, sometimes centralise family work in one branch, so confirm which office will handle your file and whether meetings can be held remotely.

Finally, ask about the team rather than just the name on the door. Much of the work will be done by a trainee, paralegal or chartered legal executive under supervision, and their hourly rate should be lower. That is not a problem if the file is properly supervised — but you are entitled to know who is doing what, and at what price.

When to change solicitor mid-case

Switching mid-proceedings is possible and sometimes necessary, but it costs time and money. The new firm will need to obtain the file, which the previous solicitor can charge for, and a transfer of file often takes two to four weeks. Courts are sympathetic to a genuine change of representation but less so where delay appears tactical, particularly in children cases where timetables are already tight.

Common triggers for a change include unanswered correspondence, costs escalating without explanation, and a mismatch over strategy — for example, a solicitor pressing for a contested final hearing when you wanted to explore settlement. Raise concerns in writing first. A formal complaint to the firm's client care partner, and if unresolved to the Legal Ombudsman, is free and often more effective than starting again elsewhere.
